Welcome to 1Kalameh Network (“1Kalameh”, “we”, “us” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and any content, information, or services made available through it (collectively, the “Site”).

If the Site allows you to submit or share content (e.g., comments, messages, or other material) (“User Content”), you remain responsible for such content and represent that you have all necessary rights to submit it.

You agree that your User Content will not:

  • Contain any defamatory, abusive, hateful, or discriminatory language;
  • Include any obscene, pornographic, or otherwise inappropriate material;
  • Infringe any intellectual property rights or privacy rights;
  • Contain viruses, malware, or other harmful code.

By submitting User Content, you grant 1Kalameh a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display such content in connection with operating and promoting the Site, subject to our Privacy Policy.

11. Limitation of Liability

To the fullest extent permitted by law, in no event shall 1Kalameh, its directors, officers, employees, volunteers, or agents be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages of any kind, including but not limited to loss of profits, loss of data, or other intangible losses, arising out of or in connection with:

  • Your access to or use of, or inability to access or use, the Site;

This limitation applies whether the claim is based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, whether or not we have been informed of the possibility of such damage.

You agree to indemnify, defend, and hold harmless 1Kalameh, its directors, officers, employees, volunteers, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your violation of any rights of another person or entity;
  • Your User Content.

13. Termination & Suspension

We may, at our sole discretion, suspend or terminate your access to the Site, without prior notice or liability, for any reason, including if we believe you have violated these Terms or applicable law.

Upon termination, your right to use the Site will immediately cease. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitations of liability, and indemnity) shall so survive.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the “Effective Date” at the top of this page and may, where appropriate, post a notice on the Site.

Your continued use of the Site after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Site.

15. Governing Law & Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any dispute arising out of or relating to these Terms or the Site shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, located in Toronto, Ontario, Canada.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices posted on the Site, constitute the entire agreement between you and 1Kalameh regarding your use of the Site and supersede any prior or contemporaneous agreements, communications, and proposals (whether oral, written, or electronic) between you and us with respect to the Site.
